These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and Swarm ("we," "us," or "our") governing your access to and use of the Swarm platform at useswarm.co and all associated services (the "Service").

You may create or join organizations to collaborate with team members. Organization owners and admins are responsible for managing members, roles, and permissions within their organization. Seat limits and feature access are determined by your subscription plan.
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
You retain ownership of all content you submit to the Service, including target URLs, test configurations, persona definitions, and authentication credentials ("Your Content"). By using the Service, you grant us a limited, non-exclusive license to process Your Content solely for the purpose of providing the Service to you.
If you provide authentication credentials (login details or session cookies) for testing authenticated flows, you represent that you are authorized to use and share those credentials for testing purposes. All credentials are encrypted using AES-256-GCM before storage and are decrypted only during active test execution.
During test execution, the Service captures screenshots and generates reports from your target application. These artifacts are stored securely and are accessible only to members of your organization. You are responsible for ensuring that test artifacts do not capture sensitive end-user data from your application.
We do not use Your Content, including test data, screenshots, credentials, or any information from your target applications, to train AI or machine learning models. Your data is processed solely to deliver the Service.
The Service is available under various subscription plans, including a free tier with limited features. Paid plans offer additional capabilities, higher usage limits, and expanded seat counts for your organization.
Paid subscriptions are billed in advance on a recurring basis through Stripe, our payment processor. By subscribing, you authorize us to charge your payment method on file. All fees are quoted in USD unless otherwise stated.
You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. We do not provide prorated refunds for partial billing periods.
We may change our pricing with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle following the notice period.
The Service, including its software, design, documentation, trademarks, and all associated intellectual property, is owned by Swarm and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without prior written consent.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in our Privacy Policy.
We strive to maintain 99.9% uptime for the Service. However, the Service is provided "as is" and we do not guarantee uninterrupted availability. Scheduled maintenance windows will be communicated in advance when possible.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice for material changes that affect your use of the Service.
To the maximum extent permitted by law, Swarm and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.
Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Swarm, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, secure, or uninterrupted, or that test results will be accurate or complete. UX insights and recommendations generated by the Service are AI-assisted suggestions and should not be treated as definitive assessments.
You may terminate your account at any time by contacting us or through your account settings. Upon termination, your access to the Service will cease and we will delete your data in accordance with our Privacy Policy.
We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or engage in conduct that we reasonably believe is harmful to the Service or other users. We will provide notice before termination when practicable.
Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Dispute Resolution) will continue to apply.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be conducted in English.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
